Session Agreement & Model Release

This agreement is between Arslan Manzoor, trading as The Virtual Sessions ("the Photographer", "I", "me") and the person booking and appearing in the session ("the Model", "you"). It applies to every session booked through thevirtualsessions.com, alongside the Terms of Service and the Refund & Rescheduling Policy.
You accept this agreement when you tick the agreement box at booking. Electronic acceptance is as binding as a signature. If you don't agree, please don't book.
1. Ownership and copyright
1.1 I own the copyright and all rights in every image, video and recording created during the session. This includes final edits, unedited frames, outtakes and behind-the-scenes material ("the Images"). 1.2 Unedited files and outtakes are not delivered and remain my property. 1.3 Because sessions are captured through your device, image files may remain on your phone or computer after the shoot. These files are still covered by this agreement. You may not edit, publish, share or sell them. Use only the final edited images I deliver to you, and delete any other captures from the session when I ask you to.
2. Model release: what I can do with the Images
2.1 You grant me a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, edit, publish and display the Images and your likeness in them, in any media now known or created in future, including: - my portfolio, website and social media - advertising and promotion of my photography services - the members-only Sessions Archive and other paid content - prints, books and other products, including selling prints in my store - exhibitions, competitions, and submissions to magazines and publications (for example Photo Vogue) - behind-the-scenes and educational material, such as posing and lighting breakdowns. 2.2 I may use your first name or professional name, and tag your public social media profile, alongside the Images. I will never publish your contact details, address or exact location. 2.3 I may retouch, crop, colour-grade and edit the Images in line with my creative style. 2.4 You will not receive any further payment for these uses. The session fee you pay covers the photography service and the licence described in section 3. 2.5 I will never license your likeness to a third-party brand for their own advertising without your separate written consent.
3. Your licence: what you can do with the Images
3.1 Once the session is paid in full, you receive a personal, non-exclusive, non-transferable licence to use the final edited images I deliver for: - your personal social media and websites - your modelling or acting portfolio, comp cards and casting submissions - submissions to modelling or talent agencies. 3.2 When posting, please credit @thevirtualsessions or "Photo: Arslan Manzoor". 3.3 You may not, without my written permission: - use the Images commercially (advertising, selling products or services, brand campaigns, paid promotions) - sell, sublicense or give the Images to third parties (for example a brand or magazine) - submit the Images to competitions or publications under your own name - apply filters or edits beyond simple cropping - use the Images to train AI or create AI-generated content. 3.4 Commercial and brand use is available through a Campaign booking or a separate written licence.
4. Behind-the-scenes and recording
4.1 I may record the session, or take screenshots of the call, for quality, editing reference and behind-the-scenes content. Section 2 applies to this material. 4.2 You may not record the session, or share recordings of my direction, without my written consent.
5. Your comfort and boundaries
5.1 Nudity is never required. Lingerie, swimwear or implied-nude concepts are only shot if you request them or agree to them in writing before the session. 5.2 You can decline any pose, outfit or concept, take a break, or stop the session at any time, with no pressure. 5.3 I will never ask for explicit content. If you ever feel uncomfortable, tell me during the session or email hello@thevirtualsessions.com.
6. Your confirmations
By booking you confirm that: 6.1 You are 18 or older and can enter this agreement. I may ask for photo ID to verify your age. 6.2 If you are under 18, a parent or legal guardian has accepted this agreement on your behalf and will be present for the whole session. Sessions with under-18s are limited to fully clothed fashion and portrait work. 6.3 You have permission to shoot in the location you choose, and it is safe to do so. 6.4 Anyone else who appears in the Images has agreed to it. 6.5 You are not under an exclusive agency or brand contract that prevents this shoot, or you have your agency's permission. 6.6 The information you give at booking is accurate.
7. Requests to remove images
If you'd prefer a particular image not to be used publicly in future, email me. I will consider every request in good faith and stop new uses where reasonable. Images already printed, sold, published or submitted cannot be recalled.
8. Payment, cancellations and delivery
Fees, rescheduling and refunds are covered by the Refund & Rescheduling Policy. Delivery times are set out in the Terms of Service. Your licence in section 3 starts once the session is paid in full.
9. Liability
You take part at your own risk and are responsible for your safety, surroundings, outfits and props during the session. I am not liable for injury, loss or damage outside my control, or for problems caused by your device or connection. My total liability is limited to the fee you paid for the session.
10. Agencies and brands
Campaign bookings made by agencies or brands are covered by a separate written agreement. Where an agency books on a model's behalf, the agency confirms the model has read and accepted this agreement.
11. General
This agreement, together with the Terms of Service and the Refund & Rescheduling Policy, is the full agreement between us for the session. If any part is found unenforceable, the rest remains in effect. Any dispute will first be discussed in good faith by email.
